The Condemnation Process

According to the Minnesota Constitution, Article I, Section 13, private property may not be taken, destroyed or damaged for public use “without just compensation.”

Once the route is finalized, the Utilities will contact all landowners to try and obtain an easement to build their transmission line on your land. A representative of the Utilities will contact you or may just stop by your property. The Utilities will then make an offer to compensate you for any property rights (easements, either permanent or temporary or outright purchase of a portion of your property) they need to acquire for the project.

It is important to know that you are not required to accept the first offer from the Utilities. The first offer is typically the lowest amount of money you can expect to receive. You should fully understand your rights and the impact, now and in the future, on your property by this project before you accept or decline any offer.
